Welcome to Elucidate Studios, a professional wedding photography and videography company. By accessing and using our website (the "Site") and engaging in our services, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read them carefully before using our Site or booking services with us.

By using the Elucidate Studios website, you ("User" or "Client") agree to these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these Terms, please refrain from using our Site.

 

2. Use of Website

  • Eligibility: You must be at least 18 years of age to use our Site and services.

  • License to Use: Elucidate Studios grants you a non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes, in accordance with these Terms. All rights not explicitly granted are reserved.

Elucidate Studios offers professional wedding photography, videography, and related services (collectively referred to as the "Services"). Our offerings are outlined in the Service Agreement and may include:

  • Wedding day photography/videography.

  • Engagement or pre-wedding photoshoots.

  • Albums, prints, or other related products.

  • Image and video editing, and post-production services.

All details of the specific services provided, including pricing, timelines, and other terms, will be covered in our formal Service Agreement that must be signed by both parties.

 

4. Booking and Payment

  • Booking Process: To book our Services, you will need to fill out a booking form and sign a Service Agreement. A deposit is required to secure your wedding date.

  • Payment Terms: Full payment is due according to the schedule outlined in your Service Agreement. We accept payments through standard means of payment.

  • Refunds: Deposits are non-refundable, as outlined in the Service Agreement. Any refund requests are subject to the cancellation terms in your contract with us.

 

5. Intellectual Property

  • Ownership of Content: All images, videos, and other media content created by Elucidate Studios are the property of Elucidate Studios. We retain all copyrights to the images and videos, and provide Clients with a limited license for personal use as outlined in the Service Agreement.

  • Use of Media for Marketing: Elucidate Studios reserves the right to use your wedding images and videos for promotional purposes, including on our website, social media, and in marketing materials. If you do not wish for your media to be used in this way, you must notify us in writing prior to your wedding day.

 

6. Third-Party Websites and Links

Our website may contain links to third-party websites or resources that are not controlled by Elucidate Studios. We are not responsible for the content, availability, or privacy practices of these third-party websites. You acknowledge and agree that Elucidate Studios shall not be liable for any damage or loss caused by using such third-party websites.

7. Privacy and Data Protection

We are committed to protecting your privacy and personal data. Any personal information you provide to us will be handled in accordance with our Privacy Policy, which is incorporated by reference into these Terms and Conditions.

8. Limitations of Liability

  • Website Use: While we strive to ensure that the information on our website is accurate and up-to-date, Elucidate Studios does not guarantee the completeness, reliability, or accuracy of any content on the Site.

  • Services Provided: Elucidate Studios is not responsible for any loss or damage that occurs during your wedding, event, or due to circumstances beyond our control, such as adverse weather conditions, technical failures, or external factors affecting our ability to provide Services.

  • Liability Cap: In no event shall Elucidate Studios' liability exceed the total amount paid by the Client for the specific Services provided under the Service Agreement.

You agree to indemnify and hold harmless Elucidate Studios, its employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your use of the Site or your breach of these Terms.

10. Amendments to These Terms

Elucidate Studios reserves the right to modify or update these Terms at any time, with the updated Terms posted on this page. Your continued use of the Site after such changes will constitute your acceptance of the modified Terms.

11. Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of Texas, and any disputes will be resolved in the courts of Texas.
